Boumediene: A Supremely Problematic Court Decision
It should also be noted that Senator Obama thinks that the decision in Boumediene v Bush is an excellent one. I don’t know what’s worse: that he doesn’t understand what the Court has done … or that he actually does and still thinks this was a sound ruling. Good luck to all of us.

I honestly don’t think SCOTUS really understands what it just did. Under Article 4 of the Geneva Convention, the insurgents we are fighting in OIF and OEF are NOT protected under the POW rules under the Law of Armed Combat, primarily because they do not carry arms openly or wear a distinctive insignia. Accordingly, in battle they may be shot on sight rather than taken prisoner. Under Boumediene, if apprehended rather than simply mowed down with 40mm, they would enjoy the rights SCOTUS creates for them. Accordingly, it is now legal to mow them all down, but not to take them prisoner and make them wear panties. Asked recently by a KBR contractor what I thought of the ruling, I said that I think we’ve taken our last prisoner.
